Welcome to ChipShotz! The terms "we", "us" and "our" refer to ChipShotz LLC. ChipShotz operates chipshotzgolf.com and all related services (the "Services"), powered by Shopify. These Terms of Service ("Terms") describe your rights and responsibilities when using our Services. Please read them carefully. By using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use our Services.

SECTION 1 - ACCESS AND ACCOUNT
By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence. You are solely responsible for maintaining the security of your account credentials and all activity on your account. You may not transfer or assign your account to any other person.

SECTION 2 - OUR PRODUCTS
ChipShotz products are made in small batches and inspected by hand in Omaha, Nebraska. We make every effort to accurately represent our products, but colors and appearance may vary depending on your device and screen settings. We do not warrant that product quality will meet your expectations beyond what is expressly stated. We reserve the right to discontinue any product or limit quantities at any time.

SECTION 3 - ORDERS
When you place an order, you are making an offer to purchase. ChipShotz reserves the right to accept or decline any order at its discretion. Your order is not accepted until we confirm it and process payment. Please review your order carefully before submitting — we may be unable to accommodate cancellations after acceptance. Returns and exchanges are subject to our Refund Policy.

SECTION 4 - PRICES AND BILLING
Prices are subject to change without notice. The price charged will be the price in effect at the time your order is placed, as shown in your order confirmation. Posted prices do not include taxes or shipping unless expressly stated. You represent that your payment information is accurate and that you are authorized to use the payment method provided.

SECTION 5 - SHIPPING AND DELIVERY
All delivery times are estimates only and are not guaranteed. We are not liable for delays caused by shipping carriers, customs processing, or events outside our control. Once we transfer your order to the carrier, risk of loss passes to you.

All content on our Services — including the Chipyramid design (patent pending), trademarks, text, images, and graphics — is owned by ChipShotz LLC or its licensors and protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent. All rights not expressly granted are reserved.

SECTION 7 - OPTIONAL TOOLS
We may provide access to third-party tools through our Services. These are provided "as is" without any warranties or endorsement. Use of any optional tools is at your own risk.

Our Services may contain links to third-party websites. We are not responsible for the content, accuracy, or practices of those sites. Accessing third-party sites is at your own risk.

SECTION 9 - RELATIONSHIP WITH SHOPIFY
ChipShotz is powered by Shopify. All sales are made directly with ChipShotz. Shopify is not responsible for any aspect of transactions between you and ChipShotz, including any injury, damage, or loss resulting from purchased products. You expressly release Shopify and its affiliates from all such claims.

All personal information collected through our Services is subject to our Privacy Policy and Shopify's Privacy Policy. By using our Services, you acknowledge that you have read these policies.

By submitting feedback, reviews, or suggestions to us, you grant ChipShotz a perpetual, worldwide, royalty-free license to use, reproduce, and distribute that content for any purpose. You represent that you own or have rights to any feedback you submit.

We reserve the right to correct any errors, inaccuracies, or omissions and to update information or cancel orders at any time without prior notice.

You may only use our Services for lawful purposes. You may not use our Services to violate any laws, infringe intellectual property rights, transmit malicious code, scrape or extract data, impersonate others, or engage in any conduct that could harm ChipShotz, Shopify, or other users.

SOME JURISDICTIONS DO NOT ALLOW DISCLAIMER OF IMPLIED WARRANTIES, SO THIS MAY NOT APPLY TO YOU.

TO THE FULLEST EXTENT PERMITTED BY LAW, CHIPSHOTZ AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF OUR SERVICES OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

You agree to indemnify and hold harmless ChipShotz, Shopify, and their affiliates from any claims, damages, or costs (including reasonable attorneys' fees) arising from your breach of these Terms, your violation of any law, or your use of our Services.

If any provision of these Terms is found to be unlawful or unenforceable, that provision will be severed and the remaining Terms will continue in full force.

Our failure to enforce any right or provision does not constitute a waiver. These Terms constitute the entire agreement between you and ChipShotz regarding the Services and supersede all prior agreements.

SECTION 22 - GOVERNING LAW
These Terms are governed by the laws of the State of Nebraska, United States. You consent to the jurisdiction of courts located in Nebraska.

We may update these Terms at any time by posting the revised version on this page. Your continued use of our Services after changes are posted constitutes acceptance of those changes.
